In accordance with article 6 III of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy (LCEN), the following information is provided to users of the evenizer.io website (hereinafter “the Site”).

Intellectual property

All elements making up the Site (structure, text, images, photographs, illustrations, logos, trade marks, videos, animations, databases, source code and visual identity) are the exclusive property of Evenizer or of its partners, and are protected by intellectual property law.

Any reproduction, representation, modification, publication, adaptation or exploitation, in whole or in part, of these elements, by any means and on any medium whatsoever, is prohibited without the prior written authorisation of Evenizer. Any unauthorised use may constitute infringement within the meaning of articles L.335-2 et seq. of the French Intellectual Property Code.

The “Evenizer” trade mark and the logos appearing on the Site are registered with the INPI. Their use without authorisation is prohibited.

Liability

Evenizer endeavours to ensure that the information published on the Site is accurate and up to date, without being able to guarantee that it is exhaustive or free of error. The information is provided for guidance only and is liable to change.

The publisher may not be held liable for:

  • direct or indirect damage resulting from access to the Site or from its use, in particular a service interruption, unavailability, a bug or the presence of a virus;
  • the use made by the user of the information or content made available;
  • the content of third-party sites accessible from the Site.

Users are solely responsible for the security of their equipment and connection, and for the accuracy of the information they submit via the Site.

Hyperlinks

The Site may contain links to third-party sites. As those sites are independent, Evenizer exercises no control over their content and disclaims all liability in this respect. Creating a link to the Site is subject to the publisher’s prior agreement.

Personal data and cookies

The processing of personal data carried out from the Site is described in the Privacy policy below, which forms an integral part of this legal notice.

Governing law and dispute resolution

This legal notice is governed by French law. In the event of a dispute, and failing an amicable settlement, the competent courts shall be those of the jurisdiction in which the publisher’s registered office is located, subject to the mandatory rules applicable to consumers.

Privacy policy

This policy describes how Evenizer (hereinafter “we”) collects and processes the personal data of users of the evenizer.io website, in accordance with Regulation (EU) 2016/679 (GDPR) and French Act no. 78-17 of 6 January 1978 as amended, known as the “Data Protection Act”.

Recipients and processors

The data is intended for the authorised internal departments of Evenizer (sales, technical, support and administrative teams), within the limits of their remit.

We use service providers acting as processors, bound by a contract compliant with article 28 of the GDPR:

The data may also be disclosed to administrative or judicial authorities where the law requires it. We neither sell nor rent personal data to third parties.

Transfers outside the European Union

Some providers may be established outside the European Union. In that case, transfers are governed by one of the mechanisms provided for in chapter V of the GDPR: an adequacy decision of the European Commission (in particular the EU-U.S. Data Privacy Framework for certified US providers) or standard contractual clauses, together with supplementary measures. A copy of the safeguards in place may be obtained on request at dpo@evenizer.io.

Retention periods

Data is kept only for as long as is necessary for the purposes described in section 3. At the end of those periods, it is deleted or anonymised, save for intermediate archiving justified by a legal obligation or by the establishment, exercise or defence of legal claims.

Security

We implement appropriate technical and organisational measures to protect data against destruction, loss, alteration, disclosure or unauthorised access, in particular:

  • encryption of exchanges via HTTPS/TLS;
  • hashing of passwords;
  • management of permissions and authentication of administrator access;
  • regular backups and access logging;
  • awareness training for staff authorised to process the data.

Your rights

In accordance with articles 15 to 22 of the GDPR, you have the following rights:

  • the right to access your data and to obtain a copy of it;
  • the right to rectification of inaccurate or incomplete data;
  • the right to erasure, under the conditions laid down by the GDPR;
  • the right to restriction of processing;
  • the right to portability of the data you have provided to us;
  • the right to object, in particular to direct marketing;
  • the right to withdraw your consent at any time, without affecting the lawfulness of processing carried out before that withdrawal;
  • the right to give instructions as to what happens to your data after your death.

To exercise these rights, write to dpo@evenizer.io or to 31 rue du Caire 75002 Paris France. We reply within one month, extendable by two months for complex requests. Proof of identity may be requested if there is reasonable doubt as to your identity.

If, after contacting us, you consider that your rights are not being respected, you may lodge a complaint with the CNIL: 3 place de Fontenoy, TSA 80715, 75334 Paris Cedex 07, www.cnil.fr.

Cookies and trackers

The Site places no advertising, personalisation or audience-measurement cookies, and uses no traffic-statistics tool. There is therefore no consent banner to display. Only two items are kept by your browser, and neither of them makes it possible to identify you:

These items are strictly necessary for the Site to work or for its security: they are exempt from consent within the meaning of article 82 of the French Data Protection Act. You may delete them at any time from your browser settings; the Site remains accessible, but it will no longer remember the language you had chosen.

Pages that embed a HubSpot service (the contact form and the demo calendar) load resources from HubSpot’s servers, which may place its own trackers. Details are set out in HubSpot’s privacy policy.

Changes to this policy

This policy may be updated to reflect legal, technical or functional developments. The applicable version is the one published on the Site on the date of consultation; any substantial change will be the subject of specific notice to users.
